Özet:
Eğitim hakkı insan haklarının temel dayanağını oluşturmaktadır. Eğitim, engelli bireylerin toplumsal hayata katılımını düzenleyen, toplumsal hayattan dışlanmalarının önlenmesine yönelik yasal düzenlemelerin gerçekleştirildiği alanların başında gelmektedir. Ancak, eğitim hakkı engelli bireylere yönelik oluşturulan politikaların içinde en çok tartışılan konulardan biri olmuştur. Bu çerçevede engelli bireylerin temel insan haklarından biri olan eğitim hakkından eşit şekilde faydalanmalarını sağlamak devletin en önemli görevlerinden biri olup konu ile ilgili hem uluslararası hem de ulusal mevzuat önem kazanmaktadır. Bu çalışmanın amacı dünyada ve Türkiye’de engelli bireylerin eğitim hakkı ile ilgili düzenlemelerin gelişim sürecini değerlendirmektir. Bu kapsamda ilgili alanyazındaki çalışmalar incelenerek öncelikle engelliliğe ilişkin temel çerçeveye değinilecek, daha sonra dünyada eğitim hakkının genel gelişimi çerçevesinde engelli bireylerin eğitim hakkının gelişimi ele alınacak ve son olarak Türkiye’de engelli bireylerin eğitim hakkına ilişkin yasal düzenlemelere yer verilecektir.

Abstract:
The right to education constitutes the fundamental basis of human rights. Education is one of the areas where legal arrangements are made to regulate the participation of persons with disabilities in social life and to prevent their exclusion from social life. However, the right to education has been one of the most debated issues in the policies developed for persons with disabilities. In this framework, it is one of the most important duties of the state to ensure that individuals with disabilities benefit equally from the right to education, which is one of the fundamental human rights, and both international and national legislation on the subject gains importance. The aim of this study is to evaluate the development process of regulations on the right to education of persons with disabilities in the world and in Turkey. In this context, the studies in the relevant literature will be examined and firstly the basic framework of disability will be mentioned, then the development of the right to education of individuals with disabilities within the framework of the general development of the right to education in the world will be reviewed and finally the legal regulations regarding the right to education of individuals with disabilities in Turkey will be included.
